St. Louis--It's been 100 days since the murder of unarmed, black, 18-year old Michael Brown.

He was shot and killed by officer Darren Wilson.

Tribe X organized a die-in on November 16, 2014 at the Delmar Loop in St. Louis to commemorate this inauspicious occasion. This was a pre-emptive action before the Missouri was placed in a state of emergency by Governor Jay Nixon and news of the indictment or non-indictment came down.

No justice, no peace. Fists up! Fight back!

Jordan Miles Civil Trial #2 – Day 3 – Court Report – 12 March 2014

The second full day of testimony in the Jordan Miles trial was fiery til the end.

Police procedure expert R. Paul McCauley testified about problems with the officers’ accounts regarding the night of January 12, 2010, such as the officers not immediately checking Jordan’s waist for the gun Saldutte thought he “felt”.

“Impacting the head and neck is only justified when there is a cause for deadly force,” he explained to the jury, regarding injuries to Jordan’s head and neck. His testimony was pretty much the same as last year.

Following McCauley, we heard from former Pittsburgh Police Officer David Horak, a witness never called before.

Horak was one of the officers who drove the transport van responding to officer Ewing’s code-1 (Everything is under control/Proceed here slowly) back-up call, when Miles was taken into custody following the altercation.

Horak’s testimony would contradict officers Saldutte, Ewing and Sisak’s version of the night. Horak also contradicted himself multiple times in his own testimony.

“When we spoke before the trial, did you not tell me how uncomfortable you were testifying against other officers?” Robert Giroux asked.

“It’s very unsettling up here,” Horak replied.

Officer Horak would also testify that, on the night in question, it was not snowing and that the roads were clear, contradicting the defense opening arguments that it was snowing with low visibility.

Horak would also go on to testify that at no time did the three officers run Jordan’s identification to check for warrants, or ask Monica Wooding if she knew a Jordan Miles, who lived down the street from her.

Opening arguments began with a flurry of accusations before the first witness had even testified.

Jordan’s lawyer Robert Giroux began attacking the officers account of their encounter with Jordan Miles.

“I’ll tell you what they’re going to say (referring to the defense). Their CYA (cover your ass) story.”

“Their search for a gun was nonsense. How can you prove there was a bulge in his pocket, when you threw away the bottle?”

“They’ll tell you, he caused us to beat him up.”

Giroux ripped apart the entire police defense plan in his hour-long argument, as well as warning the jury that the defense will try to manipulate their feelings to secure a ruling in favor of the officers.

“That’s how desperate they are, to use these bullets to justify their actions,” Giroux hinted toward a cover up.

Opening first for the defense, James Wymard, recycled his opening from the first trial with minor differences. He emphazied how bad crime is in the Homewood area, mentioning burglary and rape multiple times as he addressed the four male, four female, all-white jury.

His argument was interrupted multiple times by Giroux objections. Giroux noted that much of what Wymard said was argumentative or trying to play to the jury’s feelings. His objections were sustained multiple times.

Wymard, kept telling the jurors that all Miles had to do was “stop” and then none of us would be in the courtroom today.

“We have no burden to prove anything in this case, It’s all on the plaintiffs,” another recycled line fromthe first trial.

Jury selection began today in the second Jordan Miles V. Saldutte et al civil suit in federal court.

Out of the 61 potential jurors, only 5 were of African American descent. Three jurors were dismissed immediately, after presenting letters of hardship to Judge David Cercone, lowering the total pool to 58 potential jurors.

Out of the 58 remaining jurors, 33 informed the court that they were familiar with the Jordan Miles case through the TV, Internet, word of mouth, or in print. Despite this being nigh impossible for any resident of Pittsburgh at any point during the last four years, all of the 33 were dismissed.

One out of the five African-American potential jurors had served as a juror in the past in a police misconduct case. He was dismissed.

Attorneys for the defense, Campell, Wymard, and Leight seemed very pleased with themselves forgetting admitted into evidence bullets allegedly found on Monica Wooding’s property days after the altercation between the three officers and Miles.

Judge Cercone opened today’s proceedings with light-hearted humor, referencing popular movies such as My Cousin Vinnie, and informed jurors that the constitution exists to keep government out of our lives, aside from paying our taxes and doing jury duty. Cercone leaned fully back in his chair, as phase 1 and 2 of jury questioning began. Phase 3 of the selection/questioning process was conducted away from the public, inside the judge’s chambers.

Most of the questions to jurors related to their professions, where they lived, if they had an attorney, and what their spouses/children did for a living. Several of the potential jurors were, in fact, lawyers themselves.

PITTSBURGH - The American Civil Liberties Union of Pennsylvania filed a federal lawsuit today on behalf of Dennis Henderson, an African-American teacher who was arrested and jailed for 12 hours after criticizing the speed of a white Pittsburgh police officer driving by. All charges against Henderson were dropped by the district attorney, and the Office of Municipal Investigations (OMI) determined that the police officer had acted improperly.

Henderson, 38, an award-winning social studies teacher at Manchester Academic Charter School, was arrested within minutes of leaving a community meeting in Homewood that included a discussion of ways to improve relations with police.

"I want to show my students that, regardless of your neighborhood, ethnicity, attire, age, or socioeconomic status, no one should be harassed, arrested and placed into the criminal justice system by a police officer who operates under a code of profiling, provoking and arresting individuals without just cause," Henderson said.

Shortly after leaving the June 26, 2013, meeting, Henderson and Rossano Stewart, a freelance photographer for the New Pittsburgh Courier, were standing next to Henderson's car when a Pittsburgh police car sped by them. Both men pressed themselves against Henderson's vehicle to avoid being hit, and Henderson exclaimed, "Wow."

The driver of the car, Officer Jonathan Gromek, made an abrupt U-turn at the corner and pulled up next to Henderson and Stewart and asked, "Do you have a problem?" Henderson expressed concern about Officer Gromek's driving and said he intended to file a complaint about him. Henderson then asked Officer Gromek for his name and badge number.

Red Ribbon Grand Jury ~ Chadron, NE ~ June 24th 2008
Testimony regarding specific crimes and specific injustices which exemplify the atmosphere of fascism in Dawes county Nebraska.

While covering the plight of the Lakota in Chadron the NOmadjik Media bus was sabatoged with deep red clay in the fuel lines.  We were immobilized and all mechanics who responded to fix it changed their minds a day after agreeing to do the job.  During this period a little research showed that a month earlier a journalist who had been studying racism in Chadron and had dissappeared several years before had just been unearthed in a local park... not all that well hidden in a relatively populated area.   The public was to believe the body had been there for several years without being detected in the numerous man hunts that had combed the area after he went missing.  We were lucky enough to be a AAA member with towing privledges; so after a week or more of being harassed by local police & kindly not helped by local businesses, we were able to be towed 100 miles to the safety of a real international truck shop.   At this point we had not yet published anything about the issues in Chadron.   Along the way our tow truck driver confided to us that he used to work as a guard at the local prison (where the current police chief had been warden).  We were a little concerned about that since he was taking us "somewhere".

Breaking: Former Pittsburgh Police Chief Nate Harper Indicted

US Magistrate Robert Mitchell announced moments ago that former Pittsburgh Police chief Nate Harper has been indicted by a federal grand jury on charges of conspiracy and tax evasion (4 counts). A warrant for Harper's arrest was issued shortly after the indictment.

Nate Harper resigned last month amid a FBI and IRS investigation into misappropriation of funds from the Pittsburgh Bureau of Police's special events department which handles special officer securty details at bars, events and more. Investigators accuse Harper of redirecting funds from the special events department into Police credit union accounts. Using the funds for lush condos for VIP's during Pittsburgh's G20 Summit, a party for an officer's promotion, nights out on the town including visits to Silky's gentlemen's club in Mckee's rocks as well as multiple other unexplained expenses.

Mayor Luke Ravenstahl's body guards were also given debit cards from these credit union accounts. Harper is also accused of giving preferential treatment to friends when it comes to police contracts for new equipment in the police cruisers. The FBI and IRS will hold a press conference at 1 pm to discuss the charges.

In a press conference investigators told media that Harper failed to file taxes from 2008-2001, and used public funds to furnish his home, install a xm satellite radio for his car, and withdrew over $30,000 from the credit union for personal use. "These allegations represent the worst kind of corruption, these monies belong to the tax payers and were taken by theft." said US Attorney Hickton. Harper has also made over $400,000 between 2008 and 2011. Mobile Broadcast News will bring you more on this story as it progresses.
